H1B → F1 Day 1 CPT

H1B to F1 Change of Status + Day 1 CPT

H1B expiring, job lost, or RFE received? Changing to F1 status with a Day 1 CPT program lets you stay in the US legally, keep working full-time, and pursue a graduate degree — without leaving the country.

Who this pathway is for

H1B Lottery not selected

USCIS rejected your H1B petition and your OPT or current status is expiring.

Laid off / Job lost

Your employer terminated your H1B sponsorship and you have a 60-day grace period.

RFE or denial

Your H1B extension was denied or received an RFE and approval looks uncertain.

H1B expiring soon

You're nearing the 6-year H1B cap with no clear path to green card sponsorship.

Cap-exempt to cap

You're at a cap-exempt employer but want options outside non-profit/research roles.

Planning ahead

You want a backup plan before the next H1B lottery season.

How H1B → F1 Day 1 CPT works — step by step

  1. 01

    Check eligibility (Day 1)

Take our 60-second quiz or book a free consult. We'll confirm your current H1B status, remaining validity, any OPT history, and whether you're in the 60-day grace period.

  2. 02

Choose a partner university (Week 1)

We match you with 1–3 Day 1 CPT universities that fit your budget, program (CS, MBA, Data Science, etc.), and timeline. You apply; we handle document prep and follow-up.

  3. 03

    Receive I-20 (Week 3–6)

Once admitted, the university issues your I-20 with Day 1 CPT authorization explicitly noted. This is the critical document for your I-539.

  4. 04

File I-539 Change of Status (Week 6–8)

We guide you through filing Form I-539 (change of status, not a new visa). You're allowed to remain in the US and continue working on H1B while this is pending — as long as your H1B status remains valid.

  5. 05

    USCIS processes I-539 (Months 1–6)

Standard I-539 processing takes 3–6 months. You can continue working on your H1B during this time. Do not travel internationally while I-539 is pending.

  6. 06

    I-539 approved → enroll → Day 1 CPT (Month 3–6)

Once approved, your status changes to F1. You enroll in your program and receive CPT authorization from Day 1. Now you have F1 + full-time CPT work authorization.

Important things to know

The 60-day grace period is strict. If your H1B employer terminates you, you have 60 days to find a new employer, change status, or depart. Start this process immediately — don't wait.

No international travel while I-539 is pending. If you leave the US, your I-539 is automatically abandoned. You'd need to get an F-1 visa stamp at a consulate and re-enter.

You can keep working on H1B while I-539 is pending — as long as your H1B status is still valid (not beyond the I-94 date). CPT work authorization begins only after I-539 is approved.
